Definitions
Service provider refers to a company or organization that offers its services on the WellPay service
pursuant to an agreement it has concluded with WellPay.
Service refers to a benefit, discount or commodity offered on the WellPay service by a service
provider that has concluded a collaboration agreement with WellPay.
WellPay payment refers to a payment for a service made to a service provider via the WellPay mobile app.
Beneficiary refers to an employee who has been granted the right to use the WellPay employee benefit account at the service providers’ service points by their employer.
Benefit wallet refers to the beneficiary’s benefit account to which their employer transfers employee benefit balance and that the beneficiary manages via the WellPay mobile app.
1. WellPay service
The WellPay service is a digital employee benefit service, which operates as a mobile app.
Employees of WellPay customer companies may use employee benefits offered by their employer
via the WellPay service. The service range encompasses wellbeing, fitness, and cultural services.
An employer can manage its employees’ benefit wallets with the easy-to-use, browser-based
WellPay system, for which the Customer Service provides assistance, when necessary.
2. Operation of the WellPay service
The WellPay employee benefit service operates as a mobile app. Via the app, beneficiaries have
access to services and service points of all service providers that have signed a service provider
agreement with WellPay.
Employers procure benefit balance from Wellpay and transfer an agreed amount to personal
WellPay benefit wallets operated via the app. When beneficiaries use the WellPay app to pay for a
service at a service provider’s service point, they must present a payment confirmation.
Service providers may monitor payments via their payment terminals and confirm a payment as
paid.
3. WellPay agreement and termination practices
WellPay signs an employee benefit service agreement on the use of WellPay with the beneficiary’s
employer. No WellPay agreement is concluded between the beneficiary and WellPay. These terms
of service become binding to the beneficiary when the beneficiary confirms registration of their
benefit account in the WellPay service. The WellPay benefit wallet is valid for thirteen (13) months
from the service order date. WellPay services are valid for 13 months. If an employer terminates
the service, their beneficiaries’ benefit wallets are valid until the end of the 13-month service
period.
4. Responsibilities
Beneficiaries’ WellPay benefit accounts are personal. Beneficiaries accept that they are
responsible for the use of the service in all circumstances. WellPay is not liable for the loss or theft
of the WellPay solution or any other matter beyond the scope of its influence. WellPay delivers a
WellPay solution to the beneficiary to enable them to use service providers’ services. WellPay
only bears responsibility for the functioning of the WellPay solution.
WellPay does not under any circumstances bear any responsibility for telecommunication
disruptions or other matters beyond the scope of its influence in relation to any beneficiary and/or
their employer.
In the same manner, WellPay is also not responsible for the operations of service providers,
services offered by them, including their availability, usability and quality, damages arising from
service providers’ actions, or any other matters related to service providers.
Neither employers nor their beneficiaries may allow a third party to use the WellPay solution.
5. Reasons for interrupting the use of the service
WellPay has the right at any time to temporarily restrict the use of the WellPay service or to
prevent its use if WellPay suspects that these terms of service have been violated. WellPay does
not under any circumstances compensate beneficiaries and/or their employers for any costs
arising from the interruption of the service.
